1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Maazon LLC dba FoodCardNow ("FoodCardNow," "we," "us," or "our"), governing your access to and use of the website at foodcardnow.com and all associated services (collectively, the "Services").

By accessing or using our Services, you confirm that you are at least 18 years old and agree to be bound by these Terms. If you do not agree, do not use our Services.

2. Service Description

FoodCardNow provides online training courses and certification programs for Texas food handlers and alcohol servers, including:

• Texas Food Handler Certification training (DSHS accreditation application pending)
• Texas Alcohol Server Certification training (TABC application pending)
• Combination bundle courses
• Digital certificate issuance and employer verification tools

3. Account Registration

To access courses, you must create an account with a valid email address and password. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must notify us immediately if you suspect unauthorized access.

You agree to provide accurate and complete information during registration and to keep it updated.

4. Payment Terms

4.1 Pricing

Courses are offered at a one-time fee as displayed on our pricing page. Current prices:

• Food Handler Certification: $7.99 (one-time)
• Alcohol Server Certification: $9.99 (one-time)
• Bundle (both certifications): $14.99 (one-time)

Prices are in U.S. dollars and are subject to change without notice.

4.2 Payment Processing

Payments are processed securely by Stripe, Inc. FoodCardNow does not store your payment card information. By completing a purchase, you agree to Stripe's Terms of Service.

5. Refund Policy

We want you to be satisfied with your purchase. Our refund policy is as follows:

• Full refund: If you have not started the course (0% completion), we will issue a full refund upon request within 30 days of purchase.
• Partial completion (under 50%): If you have started but completed less than 50% of the course, contact us at support@foodcardnow.com and we will review your request on a case-by-case basis.
• No refund after 50% completion: Once you have completed 50% or more of the course content, no refund will be issued, as substantial course material has been accessed.
• No refund after certificate issuance: Once a certificate has been generated and delivered (upon passing the final exam), we cannot offer a refund, as the service has been fully delivered.
• Technical issues: If you experience a technical problem that prevents you from accessing or completing your course, contact us at support@foodcardnow.com and we will resolve it or issue a refund at our discretion.

To request a refund, email support@foodcardnow.com with your order details and the reason for your request. Refunds are processed within 5–10 business days.

6. Course Access and Certificates

Upon purchase, you are granted a non-transferable, non-exclusive license to access the purchased course(s). Course access is provided for personal, individual use only — you may not share your account or allow others to complete the course on your behalf.

Certificates are issued to the account holder upon successful completion of the course and passing the final exam with a score of 70% or higher. Unlimited exam retakes are included with each purchase.

Certificates are valid for 2 years from the date of issuance. It is your responsibility to renew your certification before expiration.

7. Acceptable Use

You agree not to:

• Use the Services for any unlawful purpose
• Attempt to circumvent course requirements or falsify exam results
• Share, reproduce, or distribute course content without authorization
• Use automated tools (bots, scripts) to access course content or complete exams
• Impersonate another person or create fraudulent certificates
• Interfere with or disrupt the Services or servers

Violation of these terms may result in immediate termination of your account without refund.

8. Intellectual Property

All content on FoodCardNow — including course materials, text, images, graphics, logos, and software — is owned by Maazon LLC or its licensors and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without prior written permission.

9. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT CERTIFICATES WILL BE ACCEPTED BY ALL EMPLOYERS OR REGULATORY BODIES.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MAAZON LLC DBA FOODCARDNOW SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF THESE TERMS OR YOUR USE OF THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE RELEVANT COURSE(S) IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless Maazon LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of the Services, violation of these Terms, or infringement of any third-party rights.

12. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to conflict of law principles. Any disputes arising out of these Terms or the Services shall be resolved exclusively in the state or federal courts located in Texas, and you consent to personal jurisdiction in such courts.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will post the updated Terms on this page with a revised "Last updated" date. Your continued use of the Services after any changes constitutes your acceptance of the new Terms.

14. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms. You may close your account at any time by contacting us. Termination does not affect any certificates already validly issued.
